Terms of Service

Essex Landscaping & Property Management

These Terms of Service (“Terms”) govern the use of services provided by Essex Landscaping & Property Management (“Essex Landscaping”, “we”, “our”, or “the Company”). By requesting or receiving services, the client (“you”, “your”, or “the Client”) agrees to these Terms.

An official written Terms of Service agreement will be signed by both the Client and Essex Landscaping before work begins. That signed agreement will supersede this online version.

1. Services Provided

Essex Landscaping provides landscaping, property maintenance, snow and ice management, seasonal cleanup, installation, grading, and related exterior services. The specific services to be performed will be outlined in a written estimate, proposal, or service agreement.

2. Quotes & Estimates

  • All quotes are based on the information provided at the time of assessment.
  • Quotes may be adjusted if site conditions differ from what was visible or disclosed.
  • Estimates are valid for 30 days unless otherwise stated.

3. Scheduling & Access

The Client agrees to:

  • Provide safe and reasonable access to the property
  • Ensure gates are unlocked or provide access instructions
  • Keep pets secured
  • Remove obstacles that may interfere with work

If access is blocked or unsafe, Essex Landscaping may reschedule or charge a return‑visit fee.

4. Weather & Service Timing

Outdoor services are affected by weather conditions. Essex Landscaping may adjust schedules for:

  • Rain
  • Storms
  • High winds
  • Snow or ice
  • Unsafe ground conditions

Snow removal services occur when conditions require, not at a guaranteed time.

5. Property Conditions

The Client is responsible for notifying Essex Landscaping of:

  • Hidden hazards
  • Irrigation lines
  • Utility lines
  • Septic systems
  • Soft ground
  • Underground features

Essex Landscaping is not responsible for damage to unmarked or undisclosed items.

6. Materials & Workmanship

All materials used will meet industry standards. Workmanship is performed to a professional standard suitable for the type of service provided.

Natural variations in soil, weather, plant performance, and site conditions may affect results.

7. Payments & Billing

Unless otherwise stated in writing:

  • Payment is due upon completion of service
  • Larger projects may require a deposit
  • Late payments may incur fees
  • Returned payments may incur administrative charges

Essex Landscaping reserves the right to pause or discontinue service for unpaid accounts.

8. Cancellations & Rescheduling

  • Clients may cancel or reschedule with reasonable notice
  • Same‑day cancellations may incur a fee
  • Seasonal or recurring services may require written cancellation

Essex Landscaping may cancel or reschedule due to weather, safety concerns, or equipment issues.

9. Liability & Limitations

Essex Landscaping carries Commercial General Liability insurance and maintains WSIB compliance for all required work classifications.

However, Essex Landscaping is not liable for:

  • Damage caused by pre‑existing conditions
  • Damage to unmarked underground items
  • Delays caused by weather or circumstances beyond our control
  • Natural changes to plant material after installation
  • Indirect, incidental, or consequential damages

The Client agrees to indemnify Essex Landscaping against claims arising from unsafe site conditions or hazards not disclosed.

10. Snow & Ice Management (If Applicable)

Snow and ice services include only the areas defined in the service agreement.

Essex Landscaping is not responsible for:

  • Areas not included in the service scope
  • Ice accumulation caused by weather conditions outside our control
  • Slip‑and‑fall incidents occurring between service visits

De‑icing materials are applied based on conditions and professional judgment.

11. Photos & Site Documentation

Essex Landscaping may take before‑and‑after photos for:

  • Quality control
  • Record keeping
  • Proof of service
  • Training
  • Marketing (only with client permission)

No identifying personal information will be included.

12. Termination of Services

Either party may terminate services with written notice. Essex Landscaping may terminate immediately if:

  • Conditions are unsafe
  • The Client violates these Terms
  • Payments are overdue

13. Privacy

Personal information is handled in accordance with our Privacy Policy and Canadian privacy laws (PIPEDA).

14. Governing Law

These Terms are governed by the laws of the Province of Ontario and applicable federal laws of Canada.

15. Superseding Agreement

A formal written Terms of Service will be signed by both the Client and Essex Landscaping before work begins. That signed agreement will override and supersede this online version.
